the answer is NO, neither you nor your attorney will get any correspondence form USCIS regarding your Name Check status/progress. However you can call the service center or take an Info Pass to get the status of your Name Check / application.

pappu, ur link talks abt GC in EB-5 category. is the requirement of $1 mn investment a reqd condition for this? in other words, if an enterprise can generate jobs for 10+ US citizens by investing a lesser amt, is that valid for filing GC under EB-5 category?

I found this interesting. Salaries for managers are becoming quite competitive in India apparently.
Given that certain areas are especially hot in India compared to the rest of the economy and that gives you a relatively strong position and quality of life. It seems the gap between US and India is closing for people in certain fields faster than it is closing for the average joe.........for whom it will take generations at best. Perhaps we need to see that perspective.

Hi,
My Company recently started Perm process and posted ads in newspaper and jobsites. We have recieved couple of resumes. One of the resume meets almost all requirements, but doesn't have enough experiance in one skill set and also doesn't have required Bachelors Degree in MIS or Computer Science or EEE.
Can we reject the candidate saying, doesn't have required bachelors Degree in above mentioned 3 fields, and not having enough experiance in one of the specified skill set?
And also do we need to do interview candidates before rejecting?

If you are not employer, your company will take care of these things.Did they ask you to help them in this regard??

3 Year Extension if I-140 is Approved
If your I-140 is Approved from Employer "A" u will get 3 Year Extension
from Employer "B" if i fall in the other Category which is Labor being filed

I got to use one of Gary Parr's "Kata" brand covers recently. They are quite nice and more importantly, they get the job done. Just a bit tough to put on but that probably isn't an issue with some practice.
The Kata consists of one part to cover the camera (and your hands), the other is a lens cover (these are interchangable - different sized for different-sized lenses).

Yes - as long as your 485 is pending and you have a US address to receive the card.
So in this case, the person should send the documents from India, correct? One of the requirement was I-94 card. How will we provide that if you are out of the country? What to say for Last Entry?

Hi,
In anticipation of birth certificate RFE, i have BC affidavits (from parents and relatives) and NAC ready to submit it will be requested. However, my priority date is not current and god knows, when it will be current.....My question is: Is there a validity period for these BC affidavits and NAC documents? It is almost one year since these documents are made ready and I was wondering if these documents lose their validity one year after the signed date on them?
Please suggest

I don't think there is a validity period for affidavits. But just make sure your parents affidavit is attested by a notary. I had a problem with the original birth certificate and I submitted a notarized statement from parents as an addendum when filing my 485 in June 2007. I had the notarized affidavit from early 2006. It was apparently sufficient.

masala_dosa, this is my understanding. once you have applied for EAD, its your responsibility to keep it valid all the time, independent of if you are using the EAD or NOT. You have to appy for renewals before it expires etc. i dont know if it impacts the current gc process or not.
two scenarios:
If you are using EAD for your current job, and if you did not renew ( or alteast file for renew) before it expires you may notbe able to continue the job.
If you are NOT using EAD, but have an EAD on hand you are supposed to keep it valid.

A hypothetical, but important debate on worst case scenario in changing job using AC21

Assume changing jobs using AC21 has some risk, debate is what is that risk. I am not expecting response like pack up and leave back to home country as I already know that. I am interested serious debate from people who used AC21 and bought houses and simulated in American culture and have family reasons to stay in US.
Lets assume USCIS send some RFE and rejected 485 that new job was not same or similar. Now -
a) How many days I have to leave country ?
b) After the rejection of adjustment of status how many days I have to wrap up my current job or I must leave it same day when rejection letter received from USCIS ?
b) After those number of days can one acquire visitor's visa for up to six months to pack up stuff, house and family on the ground of rejection of adjustment of status?
c) Can one change status to some non immigrant visa such as new H-1B or F-1 by traveling back and reentering to USA ?
d) After the rejection of adjustment of status can one still port priority date in a new green card processing ?
f) I am also interested to hear feedback on what one can do to mitigate the risk of Ac21(I already know that use attorney's advise when changing job or donot change the job)
