If your company not informed USCIS and you are again working with the same company means you are not out of status, consider 1 month as unpaid vacation. No need to stamp your visa, if you have time in I-94. If you want to go to home country, better go after having atleast 3 /6 months of continuous pay stubs with you

I have an urgent query. Please help.
I was laid off from my company AA during last week of March-2010. I have not yet singed the lay off letter. And I was rehired by the same AA company on second week of May. I have valid I 94 for next 2 years. But my visa got expired. I was out of payroll for a month. I dont have last 2 payslips.
I have joined the new client through the AA company few days before. My AA compay is asking me to go my Home country and get my Visa stamped and come back. Is there a way that I can continue the employment here without travalling to my Home country at this point ? Are any other better solutions / ways.

I found that there are 24 states under compact member, some does not requires SSN to get RN license so there are good states to get license and practices. *https://www.ncsbn.org/158.htm *However you still get stuck when it comes to sponsorship.

Dear Friends,
I finally got my RIR/EB-3 approved. My lawyer just mailed out EB-3/I-140. Now, our parent company is trying to transfer me there to work for them. Because the parent company has totally different name and tax id, that means I will need to start from H1B-PERM-I140 all over again.
If I start working for the parent company before the current EB-3/I-140 gets approved, will I still be able to use its Priority Date when I apply for the new EB-2/I-140 under parentcompany? What if the parent company decide to close down my current company before EB-3/I-140 gets approved, will that I-140 still be valid?
Any input is welcome and appreciated.

Employer needs to stop smoking weed and concentrate on work. Jokes apart there was no such proposal ever in pipeline so there is no way anything like this ever was approved. 6 year limit on H1 is a law that cannot be changed by admin process. It needs to pass house & senate. Also 6 year limit makes lot of people go back to home countries and uncle sam can consume their SS & Medicare taxes.

My current status is H1B with I-140 approved. I am planning for a fulltime MBA for which I have to transfer my visa to student visa. I heard from some sources that I cannot transfer to student visa when my 140 is approved. Does anyone here knows how far this is true?

I hope you do understand that once you change status to F-1, you essentially are losing your priority date and your GC application. Also, you will not be able to get a F-1 visa stamp on your passport as you cannot prove that you don't have an intention to immigrate (because you already had applied for and got an I-140 approved).

I really need somebody's advice on what to do next. Here is some info:
Im holding F-1 Visa, currently on OPT status until 08/2011. Filed I-140 in August 2010 as EB1 extraordinary ability - athletics.
My achievements in athletics:
1. Been in sport for 10 years.
2. Member of the National team 2003-2006.
3. Member of the University team 2006-2010.
4. Many times National Champion and prize winner of my own country.
5. Participant of World Cups and hold medals of European Championships.
6. Published in local, regional and some National newspapers at home and some local newspapers here in States.
Many others to go, but those are the major ones.
Did premium processing, got Intend to Deny. Submitted more paperwork, got denial in November 2010.
All this time had a lawyer, paid a lot of money, but as you can see, it didnt quite work out. He claimed to be a professional in this field. Never got denials before.
USCIS critique:
1. Membership in the national team is not sustained from 2006, therefore it doesnt count.. (But, I was here in states all those years, couldnt travel because was in school, plus I have a letter from a President of Athletic Federation for my sport, saying that according to my results that I showed while here in States, I would be the member easily all these years). Overall, USCIS didnt find membership in the National team to be extraordinary..
2. Some national publications are too short, there has to be a huge article about me. In regional newspapers I have huge articles, but newspapers are considered not major (however, they are professional)
Out of all criteria, they only approved one - national award. Membership and publications are not meeting the criteria. I had about 250 pages of supporting documentation.
I am very upset and dont know what to do. I am afraid to hire the lawyer, because all of them say that my case is pretty good, but we already lost a lot of money for nothing. I do not want to repeat the same mistake. My Lawyer suggested appealing the decision, but it would cost me about 15,000 more and about several years o processing. I just do not have such money and time.
I have decided to reapply and need some advice on how to go about it. I will be a self petitioner, luckily there is no employer offer needed. I may hire some lawyer, but if it is not too expensive - I need the one that knows what he is doing.
I would greatly appreciate any information. Thanks.

My EB1 is not a very strong case as it is, so we are relying on the EB3 petition. I will definitely correct my profile as suggested.
No disrespect intended, I still am not sure after reading your post whether one can take a employer sanctioned long leave of absence for a genuine reason in this case( child care).

This is a small immigration firm with one attorney but he is very knowledge and detailed . He goes by the book and provides copies of every document that he submits which I personally find very useful. A lot of my friends never get a copy of their applications so I wanted to point this out.
He does not appreciate too many phone calls and is not very patient but I feel he knows what he is doing. His support staff is very helpful.

I am working under CPT from a university. I am not planning to continue school if i get h1b. My last day to register for classes is Oct 10th. My h1b case in USCIS website days it is received and pending. I filed for premium processing on Sept 23rd, application reached to USCIS on 24th. It will be 15 calender days on Oct 9th. In this case can i work without registering at school after OCT 10th?
I will really appreciate any suggestions.
