    HI Gurus,

    I need advice from you guys,

    My priority date is June 2005 (EB2) and my I-485 receipt date is July 7th 2007 at TSC

    My questions regarding Writ of Mandamus are
    1. Would I be qualified to file for Writ of Mandamus (WOM)?
    2. If I am qualified, would it be of any benefit for me to file WOM based on my criteria as
    detailed above?

    If you are a French citizen, then yes, you can get a new H1-B visa stamp at the US Embassy in Paris. But if you are a citizen of another country, then no, you cannot get a US H1-B visa in Paris. You have the option of getting an appointment and going to a US Embassy/Consulate in Canada, Mexico, or your country of citizenship.

    Whether the French will give you a French visa is another question, but regardless, you will have to have a new US H1-B visa to get back into the country.

    First thing you need to understand is there is nothing called sponsoring a visa. You are basically saying that you will pay for their trip.
    If they have enough fund, it is better if they say that they will pay for the trip themself.
    As for other documents establishing ties, VO mostly does not ask for additional docs. They rely heavily on what is written in DS-160 and on the interview. If they have other children in India, it is best to carry a family photograph. Also, ask them to answer to the point ... who is in India, who is in US, what they do, etc.

    I entered US on H1 and the officer stamped the I-94 expiry date to the expiry date of the passport. I applied for a new passport but forgot about the I-94 expiry date. Does it mean that my H1B is expired and not valid? Can I re-enter US on the same H1B visa. Or, my H1B is no longer valid and I have to use AP?

    Please let me know.

    I dont know your exact visa background, but why do you want to use EAD, it is always better to stay on h1, if you are planning to shift employer then do h1 transfer. There are lots of threads explaining the pros and cons of using AC21 and switchin to EAD etc... but the safest way is to stay on h1.

    If you can then i would suggest staying on h1, if you are shiftin employer talk to new one to ask for h1 transfer...

    Maybe USCIS would earn more income by telling the illegal immigrants to file EAD/I-485/Biometics every year etc.. Immigration attroneys would earn good money by replying to RFEs for 12 million immigrants. Getting this 12 million illegal immigrants legalized will surely improve the economy.
    Everybody would be kept in the same backlog as we are. Illegal immigrants will stand in a que behind the legal immigrants. so you got the point

    Doesn't the EAD (AOS pending status) entitle you to be in status even after a job loss?

    Hello all,

    For past few months I hear some noice on the web that USCIS may be changing its policy soon by discontinuing Concurrent filing and allowing people to file I485 If I140 is approved irrespetive of visa number availability. How far this is true, have any body got more details on this ?? :confused:

    Since there is a mad rush of i485 applications , USCIS is going to do lottery to select applications for approval.Rest of them will be rejected.












    Just kididng guys, take it easy.


    Just gave a thought about it. USCIS can do anything. People who got rejection in H1b lottery feeling bad still.

    I just called USCIS to check the status of my case and the Immigration Officer said it is in EB-1 category. I know my case is EB-2.

    I asked the IO to see if i have send any paperwork to rectify their mistake, but she said USCIS will automatically adjust the category whe it picks up the case for review

    I am confused. Please Advice

    I was wondering if anyone has any info on the job
    market for international students in NY. I will be graduating
    in Dec and will be on the job market soon.

    Some of my friends say that there are jobs to be had but
    not many are keen on sponsoring H1, even non-tarp firms.

    Can anyone confirm/refute this?

    I heard the same from students in MIT, Harvard as well. I graduated in the 2002 tech downturn, so I know it first hand. Companies pretty much have a ban on hiring H1B.

    From the American companies' standpoint H1B has so much headache, most H1B talent is not worth the hassle unless its a critical human resource.

If convicted, you (or parent or legal guardian of an alien under age 14 who is required to give notice) can be fined up to $200 or imprisoned up to 30 days, or both. The alien may also be subject to removal from the United States. (INA � 266(b)). Compliance with the requirement to notify the USCIS of any address changes is also a condition of your stay in the United States. Failure to comply could also jeopardize your ability to obtain a future visa or other immigration benefit.

    I ran into similar circumstances in 2008 and i accepted some amount on 1099. So far nothing has happened. At that time money was more important for me than anything else. It was just one instance in my 5 years on H1. Right now i applied for I-140 and waiting for approval. I maintained my H1 status pretty good all the time. If there is ever an enquiry i'm thinking of explaining the proper reason why i accepted the payment on 1099. Hopefully there shouldn't be any problem.
    To sum it up, It is illegal to accept payments on 1099 when you are on H1. And i would advice everyone to stay away from 1099. Every case is different and you never know what is going to happen
