What has this rally given us?
Well, I can tell you that whoever flew in/ drove in/ walked 4 miles between noon and 2:30pm is convinced of the need for an organized and peaceful battle against the unfair and broken green card process. The 1000 souls that showed up on that day, besides those who pitched in any way to help them, will find sending webfaxes and meeting their lawmakers (locally) to be a piece of cake. Once that happens, things can only get better for us as a community!

Guys, Thank you all for the support. I have responded with the same kindness.
And for those who gave reds, I always thought in spite of the gloominess, we still want to ponder at what the new bulletin has is in store. Anyways, thanks to you all too. Have now learnt that discussing future VBs has become a Taboo.
There's always two sides of a coin. Don't think much about people who gave you red but there were also people who gave you green. And in this forum red and green means nothing.
It's just that some frustrated souls gives you RED and some relaxed souls give you GREEN.
There were some frustrated souls out there who gives you RED for everything, who doesn't add any value to this forum.

Please refrain from pushing OP to post employer details on public forum. Let it be OP�s weapon of surprise. I wish OP has contacted an attorney for fighting his case. If this is going to be an out of court settlement, then we shouldn�t expect complete details as well. OP's story should be an eye opener for all of us(Employees and Employers).

H1Bs approvals gets the government Millions of Dollar every year and if they can use the money to improve DHS there is no need for this addl price increases.
Think abt this any given year 85000(65000 regular + 20000 Advanced Degrees) new H1Bs approved. Atleast 50000(if not more) more are either extended or transferred. USCIS charges $2185 per application.
See the final numbers 135 000 X 2000 (approx) = 270 million dollars per year. IF they use all this money on USCIS & DHS programs we would have had a better system. Obviously all this money is going somewhere and that explains all the difficulties and frustrations we face with this BROKEN Immigration.

On your previous post you mention about salary hike and %ges...can you please clarify if a person continues to work for same employer (who filed PERM and 140) and salary hike is (base salary or bonus) 10% or more per year and AOS application process takes 2-3 years (so, total 30% difference in 3 years)...is that a negative on your application? or can it be a reason for denial?

So I am not sure if salary hike at the same employer would hurt AOS application in anyway. On the face of it, it should be a no brainier and we would like to hear that. Most of the times, we all want to hear our lawyer give us a specific reply, so even if they lawyer is telling us something which doesn't directly imply what we want to hear, we still think that that the lawyer is telling us what we wanted to hear - "selective hearing".
But some lawyers have told me that substantial salary increase (30% in 3 years can be seen as substantial) could be a problem at USCIS. They could argue that the job/job requirement/job responsibilities have changed substantially as there is a substantial change in the wage rate offered. So it’s a grey area. In effect, system is designed to keep us where we are till the time the green card petition is approved. I realize that this doesn't provide a definitive answer to your question and sorry about that, but this is as much as I could find out about the specific question.

In a matter of minutes my indicator has gone to 3 reds. Am I missing something... ?!!!
Dont worry too much about the reds. Even I used to have a couple of greens.
But when I saw many people complaining about why IV is not pursuing piecemeal,
I explained them about the Hispanic caucus and CIR.....I started getting reds
because of that.
People often give red even for rational and logical postings here if the information is uncomfortable.

I filed my I-485 on 2nd July 2007, My 180 days completes on 29th Dec 2007
I am in IT job, My job title is System Analyst and I want change the job with similar job title Sr System Analyst , But the technology(Oracle Stuff to Java Stuff) will be different then what is on labor certification.
My future employer will not file H1-B, So I have to start on EAD.
What should be process for me to do the same
* Do I need to file AC21
* If yes, Can I do the AC21 with same or Different lawyer
My advice is to take a new job, leave the current employer on good terms and forget about AC21.

A bill that would give millions of illegal aliens in the United States the opportunity to earn citizenship is closer to becoming law today as members of the Senate Judiciary Committee signaled likely passage of a proposal by Sens. Edward Kenney, D-Mass., and John McCain, R-Ariz.
Though a committee vote will not be held until after a week-long congressional recess, likely March 27, committee members appeared ready to back the Kennedy-McCain bill.
"The votes are there," said Sen. Charles Grassley, R-Iowa.
Congress is working to pass a reform bill that includes enforcement, a policy on dealing with illegals already in the country and a guest-worker program pushed by President Bush.
Under the legislation, illegal aliens in the United States would obtain six-year nonimmigrant visas under which they could work in the country and travel outside the country. The aliens would have to pay a $1,000 fine and undergo background checks.
After six years, the aliens would be able to meet certain requirements and then apply for a green card, or permanent residency.
Besides voting on the bill after the recess, committee Chairman Arlen Specter, R-Pa., said the panel also would vote on a bill by Sens. John Cornyn, R-Texas, and Jon Kyl, R-Ariz., that would give illegal aliens up to five years to leave the U.S. After returning home, they could then apply to return, either as temporary workers or for permanent residency.
"Our intention is not to strand anyone outside the country," Kyl said, according to an AP report. But he asserted the McCain-Kennedy plan would give an illegal alien allowed to stay and work in the country a "huge advantage" over a person having to wait for years in his or her own country for a green card.
The McCain-Kennedy bill would start off with offering 400,000 of the new visas.
Two years ago, Bush proposed a guest-worker program that has been criticized by immigration-reform advocates as nothing more than an amnesty program for foreigners who entered the United States illegally.
Kennedy disputed the amnesty charge: "There is no moving to the front of the line, there is no free ticket. This is not amnesty."
Majority Leader Bill Frist has threatened to bring his own immigration bill to the floor of the Senate March 27 if the committee has not approved one.

In fact, not only have some courts ordered expedited name check completions but in some cases courts have suggested that the courts have and would use their authority to adjudicate petitions if the Executive branch could not get itsact together. The attorneys and litigants who have sought federal court relief over these last several years deserve credit forforcing the Executive branch to adopt a more effective policy in this area (when it does happen, hopefully very soon).

Ah, but that was the private sector -- not head bashing against slow governmental bureaucracy. You'd be surprised to know what is going on with MS's current efforts on these matters.
